The Private Sector Approach to Commercial ADR: Commercial ADR Mechanisms in Colombia

"The resolution of commercial disputes through alternative disputes resolution methods is widely spread in Colombia. Starting in 2001, civil and commercial disputes must go through a mandatory conciliation process before being filed in court. Conciliation and arbitration account for the two most frequently used ways of resolving disputes outside of the court system. This note will focus primarily on the experiences of commercial conciliation in Colombia, although the note includes some references to arbitration as well."
