Should there be a distinct 'Mediation Privilege'

<p>A number of recent decisions concerning attempts to open up without prejudice negotiations and even mediation, in order to provide evidence for satellite litigation, caused me to consider the question of the existence or otherwise of a distinct mediation privilege.<span>&nbsp; </span>This paper considers some of those decisions and the approach of the Court to such applications.&nbsp; </p>
